This Agreement forms a binding contract between you ("Customer," "you," or "your") and TravelBluez ("we," or "us"). This Agreement regulates your access to and utilization of the travel booking, advisory, and facilitation services offered by TravelBluez (the "Services"), as detailed on our website at https://www.TravelBluez.com (the "Site").
By registering for an account or using our Services to browse or book travel, you acknowledge that you have read, understood, and agree to be legally bound by these terms. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICES.
1. Our Role as an Intermediary
TravelBluez acts strictly as an agent and intermediary between you and third-party travel service providers, including airlines, hotels, tour operators, and transport companies ("Providers"). We do not own, operate, or control these Providers. Your actual travel arrangements are subject to the terms, conditions, and liability limitations set by the respective Providers. TravelBluez is not liable for any breach of contract, negligence, or intentional misconduct by any Provider resulting in loss, injury, damage, delay, or changes in itinerary.
2. Website Access and Use
Subject to this Agreement, TravelBluez grants you a limited, non-exclusive, revocable right to access and use the Site for personal or internal business travel planning and booking purposes. You agree not to:
- Use the Site for any fraudulent or speculative bookings.
- Copy, scrape, or systematically extract data from the Site using automated means.
- Introduce viruses, malware, or disrupt the Site's underlying infrastructure.
- Violate any applicable laws, regulations, or third-party intellectual property rights.
3. Customer Responsibilities
You are solely responsible for ensuring the accuracy of all information provided during the booking process, including legal names matching government-issued IDs, travel dates, and contact details. You are also responsible for verifying and obtaining all necessary travel documents, including valid passports, visas, and health requirements/vaccinations required for your destination.
4. Payment and Fees
You agree to pay all charges, fees, and applicable taxes associated with your booking. Prices are subject to availability and may be revised by the Providers without notice until the booking is confirmed and ticketed. TravelBluez reserves the right to charge advisory, booking, or convenience fees for our Services, which will be clearly disclosed prior to payment.
5. Force Majeure
TravelBluez shall not be liable for any failure or delay in performing our obligations, nor for any loss, cancellation, or alteration of travel plans caused by events beyond our reasonable control. These events include, but are not limited to, acts of God, severe weather, natural disasters, pandemics, government restrictions, strikes, civil unrest, or airline bankruptcies.
6. Limitation of Liability
To the fullest extent permitted by law, TravelBluez will not be liable for any indirect, incidental, or consequential damages arising from your use of our Services or your travel experiences. Our total maximum liability under this Agreement is strictly limited to the total service fees or commissions directly earned and retained by TravelBluez for your specific booking in the twelve months preceding the claim.
7. Governing Law and Jurisdiction
This Agreement is governed by the laws of India. You agree to submit to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, for any disputes arising out of or related to this Agreement or the Services provided.
